1.0 - Changes in terms of service

   a) Terms of Service are subject to change at any given time as seen fit

   b) All persons who have made an art purchase are liable to these new terms

   c) Failure to follow either new or old terms will result in the removal and deletion of the artwork
   d) If confusion stirs about any given term, do not hesitate to contact me for clarification

2.0 - Do's and Don'ts

      2.1 - What you can do with art from me:
              a) Use as computer backgrounds, wallpapers, phone screens, etc.
              b) Post the image(s) to Toyhou.se (with credit to xDirewolfy).
              c) If you are interested in receiving custom merch using your commissioned piece, please contact me for permission first.

      2.2 - What you cannot do with art from me:
             a) Alter the art piece or remove the watermark.
             b) Sell the artwork to another person, unless trading or selling the character to someone as a whole.
             c) Claim my artwork as your own.
 

3.0 - Commission Terms
           a) I reserve the right to decline any commission for any reason
           b) Payment is only required after I have started finalizing the piece. This way, if I am unable to finish for any reason, there is no                               confusion about refunding.
           c) If I am unable to complete the piece, you are not permitted to use any progress showcases/WIPs for any given reason.


      3.1 - How to commission, what to provide

            a) When commissioning me, please be available and have resources ready. If I need to ask you questions, you are required to be readily                    available to answering as I cannot start until I have all of the details necessary (timezones and personal issues of course are an                                exception).
           b) See below the lists of things I will and will not draw. Do not request any of these things. Your request will be denied.
            c) You will be sent a variety of WIPs along the sketching process to confirm that everything looks alright. All changes you request will                      be free.
            d) Please allow me up to 2 weeks to complete your commission. Do not approach me with a couple days notice to tell me there is a                         deadline.

            e) You are required to provide me with clear references (either reference sheets or different posed art pieces), that are not shaded! I will                    not be able to get the right colors for your character if they are shaded.
 

      3.2 - Process

            a) After receiving your request, I will start making sketches for your approval. You can also request this be a surprise and I will not show                  you WIPs until the final piece (see 5.1, e for more)
           b) Anywhere from 1-3 sketches will be provided depending on information given, and you may choose from any of the options given,                      and I will continue to build off of that
            c) Payment will be required after the final rough draft has been approved by you. I will then start the linework, color, and shading.
            d) Once all is complete and I've gotten your payment, you will receive your piece. 

4.0 - Usage and Copyright
      4.1 - Crediting properly

            a) When posting any form of media that involves the artwork in question, I require credit at all times. I can be properly credited by the                      following:

                          - Character by https://Toyhou.se/xDirewolfy
            b) You must understand that "art not by me" is not a valid form of credit.
            c) You are permitted to publish your works on social media, as long as you properly give me credit
            d) Under any circumstances, do not remove my watermark from the final image. In the case that I still have the SAI2 file, I am more                       than happy to move it to another part of the piece for you.

      4.2  My Usage
            a) By commissioning me, you agree that I will be able to use the finalized piece in galleries to give proof and examples of completed                        work (you will be credited properly on each piece)


5.0 - Payment
    5.1 - Monetary, art, or game currency payments
             a) Payment is not required until the finalizing touches are being added to the piece
             b) All payments must be made in USD via PayPal or Ko-fi only. 
             c) Unless I am specifically asking for other forms of payment (game currency, steam currency, trades, etc), please do not offer with                           anything other than USD
             d) Depending on the complexity of your character, you may be charged up to $10 extra maximum. If you're not sure if you will be                             charged extra, feel free to ask!

 

6.0 - Removal agreement
       6.1 - Terms of removal/term breaking
             a) In the case of failure to credit me properly, you will first be asked to edit your post or page and fully provide me credit.

             b) Refusal to credit me on any given post regardless of media subjects you to a DMCA notice to have the post removed.
             c) Any and all failure to abide to (2.2, a, b, c) will result in the immediate termination of your permission to use the artwork. 
             d) Under any case of refusal of the above terms (6.1. c), you are subject to a DMCA without warning
             e) Any failure to abide by my blacklist terms will result in you being blacklisted from my work.
